Uttarakhand HC quashes order of state CIC

Nainital, Mar 16 (PTI) The Uttarakhand High Court has quashed an order of the state Chief Information Commissioner imposing financial penalty and disciplinary action on a Public Information Officer (PIO).

A single bench of Justice B S Verma gave this order yesterday on the petition filled by the PIO Jagdish Chandra Kanpal.

According to the counsel for the petitioner, an application from Surendra Agrawal, resident of Dehradun, seeking information on issuing Hill Certificate was submitted to Kanpal when he was performing the duties of a PIO in his capacity as a Sub-divisional Magistrate.

The counsel said Kanpal asked Agarwal to complete the process but he appealed to the State Information Commission, which without hearing the PIO, in June 2009 imposed a penalty of Rs 5,000 and ordered departmental disciplinary action against him
